If you think your pay practices are okay simply because you are paying people comparably within the same job, think again. July 2018, marks the effective date of the Massachusetts Pay Equity Law.
This law is redefining what it means to pay employees in a fair and equitable manner and it is forcing Massachusetts employers to closely re-examine their pay practices across positions that are "substantially similar" in scope. What is your real risk? When is it okay to pay people differently?
This briefing will outline some of the common causes for pay inequities, the impact of the Massachusetts Pay Equity Law on pay practices and we will discuss strategies for auditing your current pay practices and corrective action strategies to help you mitigate risk.
Patti D'Amaddio, Director of HR Services with Employers Association of the NorthEast and John Gannon, Partner at Skoler Abbott, will review the guidelines and answer your questions.
Some of the key topics include:
- An overview of the law and key compliance measures
- Whether incentive pay and benefits (such as vacation, holidays, etc.) are included in the term "wages" under the Act (they are)
- What constitutes a valid seniority system and merit system
- Whether market forces can be used to justify pay disparities (they can't)
- Whether employers can ask applicants what their salary expectations are (they can)
- What it means for a self-evaluation to be performed in "good faith," as well as providing some tips for employers on how to conduct a good-faith self-evaluation
